Consumer (B2C): A natural person purchasing products for purposes outside their trade, business, craft or profession.

Business Customer (B2B): A company, organisation or individual purchasing products for business or professional purposes.

Customer: Refers to both consumers and business customers.

Website: The Fabricos online store available at www.fabricos.eu.

These Terms apply to every quotation, order, purchase and delivery made through Fabricos.

Different or additional conditions proposed by the customer apply only if Fabricos has agreed to them in writing.

If any provision of these Terms conflicts with mandatory consumer law, the mandatory legal provision will apply.

Fabricos offers sportswear, sporting goods, accessories, footwear and related products.

Product descriptions, colours, dimensions and images are presented as accurately as reasonably possible.

Slight variations may occur because of differences in screen settings, materials and reasonable manufacturing tolerances. These variations do not affect your rights when a product materially differs from its description or confirmed specifications.

All orders are subject to acceptance. After placing an order, you will receive an order confirmation by email.

Fabricos may decline or cancel an order for legitimate reasons, including:

• Product unavailability;
• An obvious pricing or product-information error;
• Suspected fraud or unauthorised activity;
• Failure or refusal of payment authorisation; or
• Compliance with applicable legal requirements.

If Fabricos cancels a paid order, the applicable payment will be refunded using the original payment method unless another method is agreed.

All prices displayed on the Website include VAT where required by law, unless clearly stated otherwise.

For eligible business customers, VAT may be handled under a valid exemption or reverse-charge mechanism in accordance with applicable Dutch and European tax rules.

Shipping costs and any other applicable charges are displayed during checkout before payment.

Fabricos may change prices at any time. A price change will not affect an order that Fabricos has already accepted and confirmed, except where mandatory law permits correction of an obvious error.

Payments may be made using the methods offered during checkout or through an invoice or secure payment link sent by Fabricos.

Orders will normally be processed after successful payment authorisation, unless another payment arrangement has been agreed in writing.

Fabricos may suspend or cancel an order if payment cannot be authorised or completed. This does not affect any mandatory rights available to the customer.

Fabricos delivers throughout the European Union and to any other destinations made available during checkout.

Estimated delivery times are provided for guidance. If a specific delivery deadline has been expressly agreed, that deadline will apply.

Delivery may be affected by courier delays, customs procedures, force majeure or other circumstances beyond our reasonable control. Your mandatory legal rights concerning late or failed delivery remain unaffected.

Transfer of risk:

• For consumers, risk transfers when the consumer or a person designated by the consumer receives the products.
• For business customers, risk transfers upon shipment unless otherwise agreed in writing.

Customers should inspect their order within a reasonable time after delivery.

Visible damage, missing items or incorrect products should be reported promptly to info@fabricos.eu.

Reporting an issue promptly helps us investigate the delivery and provide an appropriate solution. This requirement does not limit a consumer’s mandatory statutory guarantee rights.

Consumers generally have the right to withdraw from an eligible online purchase within 14 calendar days without giving a reason.

The withdrawal period starts on the day the consumer, or a person designated by the consumer, receives the products.

To exercise this right, contact info@fabricos.eu before the withdrawal period expires.

Returned products should:

• Be unused beyond what is reasonably necessary to inspect or try the product;
• Be returned in their original condition;
• Include the original packaging where reasonably possible; and
• Include all supplied parts and accessories.

The customer is responsible for direct return shipping costs unless Fabricos has agreed otherwise or the products are damaged, defective or incorrect.

Original standard delivery costs will be refunded where required by applicable consumer law.

Subject to applicable law, the right of withdrawal does not generally apply to:

• Products made according to the customer’s measurements or specifications;
• Personalised products;
• Sealed products that are not suitable for return for health or hygiene reasons after the seal has been broken; and
• Other products expressly excluded under applicable consumer law.

These exclusions do not affect your rights if a product is defective, damaged or does not match the agreed specifications.

Please contact Fabricos before returning a product so that we can provide the correct return instructions and address.

Returns sent without prior notification may experience delays. Products showing excessive use, damage or misuse may be subject to a reduction in value or may not qualify for a change-of-mind refund, where legally permitted.

Approved refunds will be issued using the original payment method unless another method is expressly agreed.

Refunds will be processed within the period required by applicable law. Your payment provider or financial institution may require additional time to credit the refund to your account.

Consumers receive the statutory guarantee provided under applicable Dutch and European consumer law.

Products must meet the description and perform as a customer may reasonably expect, considering their nature, price, expected lifespan and intended use.

Business customers receive the warranty agreed in writing or provided by the relevant manufacturer.

Normal wear and tear, misuse, improper care, accidental damage and unauthorised alterations are not normally covered where they caused the problem.

Business purchases are governed by these Terms together with applicable commercial law and any quotation, contract or order confirmation agreed between the parties.

Unless otherwise agreed in writing:

• Business orders are binding after acceptance and confirmation;
• Business customers do not benefit from the statutory consumer right of withdrawal;
• The agreed payment terms apply to the relevant order; and
• Warranty, delivery and liability arrangements may differ from those applicable to consumer purchases.

All content on the Website, including the following, is owned by or licensed to Fabricos:

• Logos and brand elements;
• Images and photographs;
• Product descriptions;
• Graphics and illustrations;
• Written content;
• Product and website designs; and
• Website layout and other protected materials.

No content may be copied, reproduced, modified, published or commercially distributed without prior written permission from Fabricos or the relevant rights holder, except where permitted by applicable law.

Users agree not to:

• Use the Website for unlawful or fraudulent purposes;
• Attempt to gain unauthorised access to the Website;
• Upload or distribute malicious software;
• Interfere with the operation or security of the Website;
• Misrepresent their identity or authority; or
• Use the Website in a way that infringes the rights of Fabricos, another customer or any third party.

Fabricos may restrict access to the Website where reasonably necessary to protect its security, operation, customers or legal rights.

To the maximum extent permitted by applicable law, Fabricos will not be liable for indirect or consequential losses that were not reasonably foreseeable, including:

• Loss of profits;
• Business interruption;
• Loss of business opportunity; or
• Loss of data.

Nothing in these Terms excludes or restricts liability where such exclusion or restriction is prohibited by applicable law.

Nothing in this section limits a consumer’s mandatory rights concerning defective products, personal injury, product safety or any other liability that cannot legally be excluded.

Subject to mandatory legal rights, Fabricos will not be responsible for delay or failure to perform an obligation caused by circumstances beyond its reasonable control, including:

• Natural disasters;
• War, terrorism or civil unrest;
• Government restrictions;
• Transport or supply-chain disruptions;
• Pandemics or public-health emergencies;
• Power failures; and
• Major internet or communications outages.

Fabricos will take reasonable steps to minimise the effect of such circumstances and resume performance where reasonably possible.

Personal information is processed in accordance with our Privacy Policy, applicable GDPR requirements and other applicable data-protection laws.

The Website uses cookies and similar technologies for necessary functions and, where applicable, preferences, analytics and advertising.

Please include your order number, a clear description of the complaint and any relevant photographs or documents.

We aim to respond within a reasonable period and work towards an appropriate resolution.

Consumers within the European Union may also use an available Alternative Dispute Resolution mechanism where applicable.

These Terms are governed by the laws of the Netherlands.

For consumer contracts, mandatory consumer-protection laws applicable in the consumer’s country of residence remain unaffected.

Disputes will be submitted to a legally competent court in the Netherlands unless mandatory law gives the customer the right to bring proceedings before another court.

Fabricos may update these Terms to reflect changes in our business, Website, products or applicable legal requirements.

The version published on the Website at the time an order is placed applies to that purchase, unless a later change is required by mandatory law or expressly agreed with the customer.

The current version and its last-updated date will remain available on the Website.
